Welcome to the Waverley Academy Internet Site. Please review these Site Terms and Conditions of Use, which govern your use and purchase of products from our Site. By accessing, browsing, or using this Site, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree to these terms then please do not use this Site.

Course Terms & Conditions

Deposit refers to the amount payable to the Waverley Academy to secure / reserve / hold a course place. The deposit amount is non refundable unless the course or courses do not take place as all courses are subject to numbers. All payments must be made on or before specified dates. All courses are subject to numbers – deposits paid will be returned in the event of the courses not taking place. 90% attendance is compulsory for all ITEC programme’s, or students may not be entered for exams. You must inform the college of any changes in name address / phone numbers / emails etc. Failure to do so could result in important information / correspondence not being received. Most correspondence will be conducted by email. The college reserves the right to change course content / exam times / exam dates / class times / fees / dates / timetables.

You will need access to internet and email. Learners are not allowed to sell any products, equipment or services to other learners while attending programmes. The college does not take responsibility for any allergic reactions due to the use of products in classes. The responsibility is on the learner to check ingredients in products provided by the College. Learners will need to practice on each other, in the event of uneven numbers two learners may have to practice on one learner or learners may have to work on themselves. All course fees must be paid in full as agreed. Funding will be reimbursed (if applicable) by the College when received from funding agency.

The college is not responsible for exam results issued by awarding authority. Deposits and fees are not transferable and are non-refundable under any circumstances. All course fees are payable should a learner fail to complete the course. Learners under the influence of alcohol or illegal substances should not attend classes. Fees are non-refundable if the course is interrupted or cancelled through an act of god. Learners should make every effort to attend and be punctual at all classes. The College does not take any responsibility for any items/valuables belonging to learners while attend courses.

The information contained in this Site including all images, illustrations, designs, photographs, video clips, writings and other materials that appear herein are copyrights, trademarks or other intellectual property owned, controlled, or licensed (all of which, collectively, are herein referred to as the “Contents”) by the Waverley Academy, its sister companies, subsidiaries and affiliates (“Waverley Academy “) or are the property of their respective owners. The name the Waverley Academy logo are registered trademarks of the Waverley Academy.

Permission is granted to display, copy, distribute, download, & print in hard copy portions of this Site for the purposes of: Placing an order with the Waverley Academy or Using this Site as a shopping resource provided you do not modify the Site and that you retain all copyright and other proprietary notices contained in the Contents. Except in connection with shopping or placing an order, none of the Contents may be copied, reproduced, distributed, republished, downloaded, displayed, posted electronically or mechanically, transmitted, recorded, in any manner mirrored, photocopied, or reproduced without the prior written permission of the Waverley Academy or the applicable copyright owner. Please note that the permission granted herein terminates automatically if you breach any of these Site terms or conditions. About Our Course Fees

The Waverley Academy is a training company. We supply training courses to individuals and companies in the rep of Ireland and online training/courses worldwide. Deposit/course fees refers to the amount payable to the Waverley Academy to secure / reserve / hold a course place. The deposit amount/course fees are non refundable unless the course or courses do not take place as all courses are subject to numbers.

The prices advertised on this Site are for orders placed through our Site facility and include VAT. Prices and the availability of items are subject to change without notice. Any “list prices” used on this Site relate to the manufacturers’ suggested selling prices and may not be indicative of the actual selling prices in your area. Any reference to“savings”“discount”“discounts” used on this Site indicates the average savings off the “list price”“original price”. Your actual savings will vary depending upon the goods purchased and the date of the transaction. We reserve the right to limit sales.

User Comments, Feedback, & Other Information Submissions Provided By You

You agree that any material, information, and ideas that you transmit to this Site or otherwise provide to the Waverley Academy (“Transmissions”) shall be and remain with the Waverley Academy. In addition, you agree, and are hereby put on notice, that you are prohibited from posting or transmitting to or from this Site any unlawful, threatening, libelous, defamatory, inflammatory, pornographic, or profane material or any other material that could give rise to any civil or criminal liability under law. You are solely responsible for the Content of any comments you make.

Terms of Use Revisions

The Waverley Academy may revise these Terms of Use by updating this posting. You agree that in the event that any portion of these Site Terms of Use is found to be unenforceable, the remainder of these Site Terms of Use shall remain in full force and effect. By using this Site you agree to be bound by any such revisions and should
therefore periodically visit this page to determine the then current Terms of Use to which you are bound.

Learners should pay all course/exam fees on specified dates (unless otherwise agreed). Fees may be paid by credit/laser card or cash at the office or cheque, bankers draft, direct debit or postal order made payable to The Waverley Academy, Waverley Business Park Old Naas Road Dublin 12. (Please do not send cash by post or give course fees to trainers). A statement of payments will be emailed to confirm receipt of payment. Card receipts will be issued at class were applicable.

Installments of course fees are made by direct debit or by credit/laser card at no extra charge. All payments must be made even if you discontinue your training. Failure to do so may result in the debt being referred to a debt collection agency for recovery and legal action. Costs for this action will be incurred by you. Payments will be processed on the last Friday of the month (unless otherwise agreed) A fee of €12 will be applied to every payment which is declined by bank/credit card company or payment not paid on agreed dates. You will not be entered for exams if your course fees are not paid in full. You will not be entered for exams if your exam fees are not paid in full. (where applicable) It is not the policy of the college to refund fees or deposits. Your training may be suspended if you do not adhere to agreed payments and in the case of too much time elapsing training may be discontinued.

The college also reserves the right to change/alter any payment plans entered into with students.

Fees are non-refundable if the course is interrupted or cancelled through an act of god. The college reserves the right to change class times, dates, trainers, products, materials, rooms and exams where necessary or due to external factors beyond our control. In extenuating circumstances the college also reserves the right to conduct training from a different venue other than the one which you commenced your training at.

We also reserve the right to update/amend our learner handbook, terms and conditions and exam fees/payment plans/policies at any time. All individual courses are subject to numbers including courses that are advertised as combination courses. (E.g. if 2/3 certificate programmes are advertised as a combined programme, minimum numbers will be required for each individual certificate/diploma/course/ in order for it to proceed.

In the event of extenuating circumstances where by any course needs to be cancelled part-way through the college will refund learners for any parts of the programme (only) for which they have paid for and that was not completed. (Please note fees will not be refunded under any circumstances for certificates/diplomas that have been delivered in full by the college).

It is not the policy of the college to cancel classes. In the event of classes been cancelled due to unforeseen circumstances (e.g. bad weather) the Waverley Academy will make every effort possible to reschedule classes within the time frame set out for completion of the programme. However in the event of this not been possible, and the need arising, theory classes will be replaced with practical classes were relevant. Replacement classes may not be on the same day/evening as that of the course learners enrolled on. The Waverley Academy will make every effort possible to reschedule cancelled classes although due to time restraints, availability of trainer/and or facilities this may not always be possible.

Whilst every effort has been made to ensure the information contained in this document is correct, the college is not liable for any errors or omissions. It is the responsibility of the leaner to read any other documents as outlined by the Waverley Academy that relate to your studies at the college. It is the sole responsibility of learners to inform the college of any changes in name /contact numbers / address / email. Failure to do so could result in important correspondence / information not been received.

Please note correspondence will be conducted by email in the first instance. Access to a PC – learners will need access to the Internet and a PC to view important document and study aids. Learners will also need access to a printer as they will be required to print documents for their studies. Learners who are applying for exemptions from any course unit/s must supply evidence of previous studies, qualifications or course syllabus.

Learners are responsible for all materials distributed to them by the college (were applicable). The Academy cannot replace any materials lost or misplaced by learners. The College is not responsible for any items or valuables belonging to learners while attending the college e.g. mobile phones, textbooks, notebooks, folders, case studies, jewellery, pencil cases, coats, towels, equipment, products etc.

A high level of attendance is expected from learners if enrolling on attendance based programmes (although some allowances can be made in extenuating circumstances)* It is prohibited to record classes on any device. In order for all learners to gain maximum benefit from the course it is important that learners participate in all practical sessions.

In the event of any breach of college terms & conditions the college reserves the right to terminate learners immediately from the programme. It is not the policy of the college to refund fees.

Learners under the influence of alcohol or any illegal substances should not attend tutorials.

The Waverley Academy is not responsible for any technical issues beyond its control that many interfere with any of its online study/learning resources.

It is the sole responsibility of learners to complete case studies/evidence of treatments/ assignments within the time frames outlined by the college and trainers. If you do not have case studies/evidence of treatments/assignments for the day of your practical exam you will not be allow you take part in your practical exam/s.

If the examiner refers your case studies/evidence of treatments because any of the content is unsatisfactory there will be a fee of €20 for a Waverley Academy trainer to check and sign off the case studies/treatment of evidence.

If the learner has to re-sit a theory unit/s or practical unit/s there will be a re-sit fee applicable. The college is not responsible for exam results issued by awarding authority. Please find below the terms and conditions for Exams & Assessments (referred to as EA’s throughout) EA’s are conducted during courses, towards the end of courses, or when courses have finished.

If you do not pass your EA/s at your first attempt you will have one year from the date of your first attempt to complete successfully. As follows: For theoretical EA aspects you will be allowed 2 more attempts (these are referred to as re-sits). There are 2 designated periods during the year for these re-sits. For Practical EA’s you will be allowed one more attempt. There will be one designated period during the year for this. (Please note: Practical EA’s are subject to the required amount of students.)

Important Notes

• If you do not attend for any EA dates set out for you we will not arrange any other date/time for your EA. In other words, you must attend for EA’s dates (including first attempt) as scheduled, or there is no second chance.

• This applies to theory and practical EA’s.

• Fees will be charged for any EA repeats and/or any additional course work to be completed outside of course timetable/timeframe.

• The college reserves the right to change any details related to exams and/or to update exam policies.

• The college cannot be responsible for any changes made by awarding authorities to qualifications, exams or their exam policies and procedures.

Notes for programmes which relate to internal assessments/exams

You must complete all your course work including practical assessments within the course timetable/timeframe. In the event that your practical assessments (or any relevant course work) is/are not completed within the recommended timetabled classes you will not be allowed take your final practical assessment. (This will mean you will not receive your qualification as all elements of the programme will not have been completed.)

In the event that you do wish to complete any outstanding course work or EA’s outside of the course timetable/timeframe, (and assuming we can accommodate your requests) there will be minimum fee of €500 for to facilitate this.
